1. Agreement and scope

These Terms & Conditions govern the provision of interior design and execution services by Bhati Interior (“we”, “us”) to clients (“you”). By engaging our services, you agree to these terms. Specific services and deliverables are outlined in written proposals, estimates, or contracts issued for individual projects.

2. Services provided

We offer design and execution services including (but not limited to): modular kitchens, wardrobes, furniture works, false ceilings, wall paneling, glass work, wallpapers, pelmets, flooring and wall design, front elevations, and complete interior fit-outs. Each project will have a written scope, timeline, and estimate.

3. Estimates and proposals

  • All estimates are based on the information available at the time and valid for the period stated on the document.
  • Changes to scope, materials, or site conditions may require a revised estimate and additional charges.
  • A written proposal or contract supersedes any informal quotes.

4. Payment terms

  • A deposit (usually specified in the proposal) is required to begin work.
  • Progress payments or milestone payments will be defined in the contract.
  • Final payment is due on completion and handover, subject to agreed punch-list items.
  • Late payments may incur interest or delay further work.

5. Site access and client responsibilities

You must provide safe access to the site and obtain any necessary permissions. Delays caused by client unavailability, missing permits, or access restrictions may extend timelines and incur extra costs.

6. Materials and substitutions

  • We will specify materials and brands where possible. If specified materials are unavailable, we will propose suitable substitutes for your approval.
  • Material ownership transfers to you on payment as specified in the contract.

7. Changes and variations

Any changes requested after acceptance of the scope are treated as variations. Variations will be quoted separately and must be approved in writing before work proceeds.

8. Delays and force majeure

We aim to meet agreed timelines. However, we are not responsible for delays caused by events outside our control (e.g., extreme weather, supplier failures, strikes, governmental actions). In such events we will notify you and propose revised timelines.

9. Warranties and finish

  • We warrant workmanship for a period specified in the project contract (typical workmanship warranty terms will be included per project).
  • Manufacturer warranties apply for supplied products and materials and are subject to the manufacturers’ terms.
  • Normal wear and tear, misuse, or damage from third parties are not covered.

10. Liability

  • We are responsible for performing our services with reasonable care and skill.
  • Our liability for any claim arising from our services is limited to the total amounts paid for the relevant project (unless otherwise required by law). We are not liable for indirect, consequential, or punitive damages.

11. Insurance

We maintain appropriate liability insurance for our operations. You are encouraged to maintain adequate insurance for the property and contents during work.

12. Intellectual property

Designs, drawings, and documents produced by us remain our intellectual property unless otherwise agreed in writing. Once paid in full or as agreed, we grant you a licence to use project deliverables for the project purpose.

13. Confidentiality

Both parties will keep confidential any non-public information provided during the project, except where disclosure is required by law.

14. Termination

Either party may terminate the contract for material breach if the breach is not remedied within a reasonable time after written notice. Upon termination, you will pay for work completed and materials purchased up to the termination date.

15. Dispute resolution and governing law

Any disputes will be attempted to be resolved amicably. If unresolved, disputes will be governed by the laws of India and the courts in Ghaziabad, Uttar Pradesh will have jurisdiction.

16. Changes to terms

We may update these terms from time to time. For active projects, the terms in your signed contract govern. For new engagements, the latest published terms apply.
